When conducting acquisition planning activities, contracting officersare encouraged use the Non-PersonalServices Certification.
(a) This subpart provides suggestedcontract language a contracting officer may use in fixed-pricemaintenance, repair, overhaul, and modification contracts whichinclude the Walsh-Healey Public Contracts Act. This language may beused in fixed-price contracts subject to the Service Contract Act asappropriate.
(b) When contractors performing maintenance,repair, overhaul, and modification on Air Force equipment in overseaslocations are unable to obtain replacement parts through purchase inlocal markets, the contracting officer may include the followingsuggested contract language substantially as written in theperformance work statement /statement of work. Use of this languageis required for Depot Maintenance Activity Group (DMAG) contractscontaining a requirement for a government furnished material (GFM)report (GFM reporting may be by the manual report on AF Form 412(Report of Government Furnished Material), the mechanized GFMTransaction Reporting System (G009), or Commercial Asset VisibilityII (CAV II):
MAINTENANCE OF GOVERNMENT OWNED EQUIPMENT IN POSSESSION OFOVERSEAS CONTRACTORS
Normal maintenance of Government-owned equipment providedhereunder or used in the performance hereof may require parts notavailable in local markets. The Contractor may requisition any ofsuch parts as are available through the Government supply systemafter the contracting officer provides written approval for each suchrequisition. The Contractor agrees, upon receipt of such parts, tocredit this contract at prices specified in current federal supplycatalogs. The Contractor shall deduct such credits from the invoicessubmitted under this contract.
(a) For maintenance, repair, overhaul, andmodification efforts which include work request provisions for "overand above" effort on other than a fixed-price basis thecontracting officer may include the following suggested contractlanguage substantially as written in section M:
EVALUATION OF OVER AND ABOVE WORK
For evaluation purposes, the estimated "Over and Above"hours applicable to Section B of the Schedule entitled "Over andAbove Work" is (insert number of hours) hours. The estimatedover and above hours shall be multiplied by the proposed hourly ratefor evaluation. These estimated hour figures are furnished forevaluation purposes only and are not intended to guarantee that thenumber of hours used for evaluation will actually be experienced orthat the hour figure represents maximum or minimum hours for anyresultant contract. Offerors are required to submit the proposedfixed hourly rate to be inserted into Section B of the resultantcontract.
(b) The requirements office shall determinethe man-hour estimates used for evaluation, based on estimates of allfactors including previous organic and contractor experience.
(c) The contracting officer may include thefollowing suggested contract language substantially as written inSection M for maintenance, repair, overhaul, and modificationindefinite quantity and requirements solicitations that include aBest Estimated Quantity:
EVALUATION OF OFFERS
Offers shall be evaluated on the basis of the unit prices offeredfor the quantity designated as the best estimated quantity in theschedule for (insert item(s)) by multiplying the proposed price(s) bythe best estimated quantity(s).
(d) The contracting officer may include thefollowing suggested contract language substantially as written inSection M when the Government will evaluate the cost associated withrelocating government furnished property from the incumbentcontractor's facility:
EVALUATION OF OFFERS - MOVEMENT OF GOVERNMENT-FURNISHED PROPERTY
A cost factor which represents the estimated cost to thegovernment for packaging, packing, preservation and transportation ofgovernment-furnished property from the incumbent contractor'sfacilities to a new contractor's facility shall be added to alloffers except the incumbent's. This government-furnished propertyrepresents the residual inventory of government-furnished materialand any special tooling which may have been furnished. For evaluationpurposes, this cost is estimated to be (insert dollar amount), pluscost of transportation to the recipient contractor's facility.
(e) Transportation costs for any additionalgovernment-furnished property not resident at the incumbentcontractor's facility shall be evaluated based on the estimated costof transportation from the applicable Government installation to thecontractor's facility.
(f) The contracting officer may include thefollowing suggested contract language substantially as written inSection M when the Government shall evaluate transportation costbased on multiple points of generation:
EVALUATION OF OFFERS-TRANSPORTATION COST
For evaluation purposes the government shall add a cost factor fortransportation to all offers based on the distances between point(s)of destination as follows:
Transportation cost for (insert item(s)) will be evaluated on thebasis of estimates of probable points of generation in the field tothe contractor's facilities and return to the point(s) of generationand;
Transportation cost for (insert item(s)) will be evaluated on thebasis of estimates of probable points of generation in the field, tothe contractor's facilities and return to (e.g., Hill AFB).
Contracting Officer ensure contract holidays to be observed under thecontract are established in the Statement of Work, Performance WorkStatement or Statement of Objectives when contractor performanceoccurs on a government installation. Normally, the ten federalGovernment holidays are observed in the United States. Somecontractor personnel policies and labor agreements provide forobserving different holidays than observed by the Government. Services performed outside the United States usually observe theholidays of the country where the services are performed.
