SUBPART 5516.2—FIXED-PRICE CONTRACTS
5516.203 Policy.
In order to protect the contractor and the government against significant market fluctuations and in accordance with FAR 16.203-4(c)(2) and (d)(2), the following clauses and provisions are prescribed for use solely by the United States Transportation Command (USTRANSCOM) and its components in solicitations and contracts when award of a fixed-price contract with an economic price adjustment is anticipated.
5516.203-4 Solicitation Provisions and Contract Clauses.
(a) The contracting officer shall insert the provision at 5552.216-9000, Evaluation of Offers Subject to an Economic Price Adjustment Clause, in solicitations containing an economic price adjustment clause.
(b) The contracting officer shall insert a clause that is substantially the same as the clause at 5552.216-9001, Economic Price Adjustment based on Actual Cost of Fuel – Airlift, in all contracts for airlift transportation when an economic price adjustment based on actual cost of fuel is anticipated. Use the basic clause when a monthly fuel report is required or ALT 1 for reporting per mission (reference paragraph (c) of clause). Use ALT II for Civil Reserve Air Fleet (CRAF) International Services (reference paragraphs (b) and (c) of clause).
