ITEM A1 -- Head of Contracting Activity (HCA) Authority and
Designation of Procuring Activities
AFFARS 5301.601-91(b), 5306.304(a)(2)(i) and 5319.201 are revised
to reflect (i) the decision to rescind delegation of general contracting
authority to Air Intelligence Agency (AIA) and (ii) the redesignation
of the 11th Support Wing as the 11th Wing.
ITEM A2 -- Clearance Process
a. 5301.9006-5 is updated to reflect designation of BMO/PK as
SMC Detachment 10/PK.
b. 5301.9006-6 is revised to remove coverage that is redundant
with 5301.9003-2(f) and to clarify the requirements for command
supplements regarding the clearance process.
c. 5301.9007(c) is revised to delete the seven day suspense for
RFP review.

Review Authority (BCRA) as the authority for directing contract
clearance of competitive awards. 5301.9012-1(b) is also clarified.

as well as non-competitive actions. Footnote number 4 is revised
to remove an inconsistency with 5301.9006-7(a).
f. 5302.101, the definition of "Other Contacting" is
revised to delete the statement that the DAC may designate other

ITEM A3 -- Acquisition of Utility Services
As a result of FAR changes published in FAC 90-23 regarding utility
services, AFFARS Subpart 5308.3 is deleted and a new Part 5341
is established to include Subpart 5341.2, Acquiring Utility Services,
and Subsection 5341.205, Delegation of Contracting Authority.
The purpose of 5341.205 is to delegate contracting authority for
utility services to the major commands, FOAs and DRUs.
ITEM A4 -- Imprest Funds
AFFARS Subpart 5313.4 is revised to clarify Air Force contracting
office responsibility for oversight and control of imprest fund
cashiers and for the oversight and control of imprest funds for
deployed units and at isolated activities.
ITEM A5 -- Courtesy Contracting of Foreign End Products
AFFARS Section 5325.190 is revised to reflect current activity
designations for courtesy contracting of foreign end products.
For foreign end products in Europe, HQ USAFE/LGCK is identified
as the focal point to identify appropriate overseas activities.
ITEM A6 -- Base Contract Funding
AFFARS Section 5332.790 is revised to clarify procedures for issuing
solicitations under AFFARS 5332.790(b). Paragraph 5332.790(c)
is added to provide permanent coverage for executing facilities
project requirements. Previously, coverage was provided by message
AFAC each year.
ITEM A7 -- Special Termination Cost Clauses
AFFARS Section 5349.501-70 is revised to require submittal of requests to include the clause at DFARS 252.249-7000, Special Termination Costs, at least 60 days in advance of its intended use. This is necessary to enable Congressional notification as required by the Senate Appropriations Committee.
ITEM A8 -- Update to Air Force Regulation Cites
As a result of the Air Force policy initiative to replace the
extensive system of Air Force Regulations with more succinct policy
directives and implementation instructions, documents referenced
throughout the AFFARS have been replaced or eliminated. THis is
the first installment of AFFARS updates to reflect the current
document numbers. We plan to update the remaining cites in the
next AFFARS change. A list of the cite changes included in this

5313.402 General.
(a) The base contracting officer
at the office responsible for contract support of the unit to
which the imprest fund cashier is assigned shall exercise direction,
control and oversight of purchases using imprest funds. At isolated
activities and deployed organizations under emergency conditions,
this responsibility may be delegated to the senior ranking officer
for the isolated activity or deployed unit.

5332.790 Base contract funding.

(b) When a purchase request is
for one of the requirements listed in (b)(1) thru (4),
the base contracting activity may issue a solicitation, receive
and open offers, and prepare final award documents (including
contract clearance, if required). However, the contract shall
not be signed by the contracting officer; delivered to the contractor;
nor will the contractor be notified that it has been awarded a
contract until funds have been certified by the accountable AFO.
Since contract award will not be made subject to the availability
of funds, the procedure and clause prescribed at FAR 32.703-2(a)
shall not be used. If additive or deductive items are included
in the bid schedule, the contracting officer shall determine the
amount of available funds before bid opening.

to be commenced in the next fiscal year, if the approving
authority certifies that the requirement has a high enough priority
to ensure that it will not be cancelled when the next FY funds
become available. Current FY funds may be used if they become
available before the end of the FY and the contract can be obligated
as required by AFR 170-8;

(c) The MAJCOM Civil Engineer,
Director of Contracting, and Comptroller may jointly agree in
writing to authorize base contracting activities to issue solicitations
for facility project requirements when it is anticipated that
the contract will be awarded in the current fiscal year but funds
are not yet available. Use of this authority is subject to the
following
(1) MAJCOMs should carefully
consider the use of this authority. It should only be used for
non-complex projects for which estimated bid or proposal preparation
costs are relatively low in relation to the estimated cost of
the project. Also, MAJCOMs should consider imposing a limit on
either the project value or the aggregate value of all projects
solicited using this procedure.
(2) Projects that may be solicited
under this authority include those for maintenance, repair and
minor construction, facility O&M projects, and environmental
restoration and compliance projects, which the MAJCOM civil engineer
has reviewed, verified as a bona-fide need, and determined that
there is a reasonable likelihood that the project will be funded
in the annual year-end program.
(3) MAJCOM Civil Engineering
and Comptroller offices will identify to Contracting the projects
selected to be solicited under this authority, in adequate time
to permit solicitation and processing. MAJCOM Contracting, Comptroller
and Civil Engineering shall establish a reasonable cutoff date
for cancellation of solicitations, in order to have time to open
the offers and process the contract award before the end of the
FY.
(4) Solicitations may not be
opened until the funds certifying official either certifies that
funds are available, or notifies the contracting officer that
there is reasonable assurance that funds will be available after
opening. If a reasonable assurance notification is received from
the funds certifying official, the solicitation may be opened
and processed up to the point of award. However, the contract
shall not be signed by the contracting officer; delivered to the
contractor; nor will the contractor be notified that it has been
awarded a contract until funds have been certified by the accountable
AFO. If funds or a reasonable assurance notification cannot be
provided by the established cutoff date, the solicitation will
be canceled before opening.
(5) Solicitations issued under
this authority shall contain a notice on the cover sheet and in
Section L as follows:
Notice to Offerors: funds are
not presently available for this project. No award will be made
under this solicitation until funds are available. The Government
reserves the right to cancel this solicitation, either before
or after the closing date.

SUBPART 5345.3--PROVIDING GOVERNMENT
PROPERTY TO CONTRACTORS
5345.302 Providing facilities.
5345.302-1 Policy. It is the policy
of the Air Force to place the maximum reliance on the use of contractor-owned
facilities to support current RDT&E, production and maintenance
requirements. Contracting officers shall comply with the procedures
of AFI 63-701, Managing Industrial Facilities, when
furnishing government facilities to contractors.

5345.302-90 Providing watercraft
to government contractors. Prior approval of the USAF Watercraft
System Program Manager (SA-ALC/LDAC, DSN 945-4261) is required
before Air Force watercraft can be offered as Government Furnished
Equipment (GFE) in support of contract performance. In furtherance
of FAR 45.302-1, which limits the provisions of facilities to
contractors, watercraft which are available on the commercial
market will not be provided to contractors unless such action
would result in a significant benefit to the Government (See AFI
24-304, Management, Operation, Maintenance and Use of US Air
Force Watercraft).

and Health Standards (AFOSH) developed in accordance with AFI
91-301, Air Force Occupational Safety, Fire Prevention, and
Health Program in effect on the date of this contract, apply.
If contract performance is on other than an Air Force installation,
the Contractor shall comply with the safety rules of that Government
installation, in effect on the date of this contract.
