5301.601, 5302.101, 5316.405-2 Clarifies HCA responsibilities

    SUBPART 5301.6 — CAREER DEVELOPMENT, CONTRACTING AUTHORITY, AND RESPONSIBILITIES

    5301.601 General.

    (a)(i) Heads of Contracting Activities (HCAs)Responsibilities.

      (A) PEOs are the HCAs for their assigned programs and acquisitions; however, this designation of HCA does not include “Other Contracting” authority--See paragraph (B) below for the designation of HCAs for “Other Contracting”. PEOs shall not delegate HCA responsibilities unless specifically authorized elsewhere in the AFFARS.

      (B) The commanders (and when the commander is absent, the vice commanders) of the following organizations are the HCAs for “Other Contracting”: Air Combat Command (ACC), Air Education and Training Command (AETC), Air Force Reserve Command (AFRC), Air Mobility Command (AMC), Air Force Materiel Command (AFMC), Air Force Space Command (AFSPC), Pacific Air Forces (PACAF), and United States Air Forces in Europe (USAFE). The lowest level that HCA responsibilities may be delegated by AFMC and AFSPC is the SCCO, and for the commands listed above to the headquarters staff official with overall responsibility for contracting, unless specifically stated otherwise in the AFFARS.

      (C) The DAS(C) is the HCA for the following organizations: 11th Wing, Air Force Special Operations Command (AFSOC), United States Air Force Academy (USAFA), and Air Force Operational Test and Evaluation Center (AFOTEC). The DAS(C) delegates all delegable HCA responsibilities to the commanders of these organizations. All non-delegable HCA responsibilities are retained by the DAS(C). HCA responsibilities shall not be delegated lower than the level of the staff officer with overall responsibility for contracting in the organization, unless specifically stated otherwise elsewhere in the AFFARS.

      (D) DAS(C) is the HCA for Air Force component commands tasked to support a “supported commander” during JCS declared contingency operations or exercises (See Appendix CC, Part CC-2).

    (a)(ii) General Contracting Authority,

    (A) In accordance with Secretary of the Air Force Order (SAFO) 101.1 dated 5 Jun 99 and ASAF(A) memorandum regarding “Delegation of Contract and Agreement Authority” dated 30 Nov 99, the authority to enter into, approve, terminate, and take all other appropriate actions with respect to contracts, is delegated from the Secretary of the Air Force and ASAF(A) to the DAS(C) and Associate Deputy Assistant Secretary (Contracting).

    (B) This authority is hereby redelegated to MAJCOM and DRU commanders. This authority may be redelegated with or without the authority to make successive redelegations and under such terms, conditions, and limitations as may be deemed appropriate. This delegation is a general one, and all other existing or future authority, to the extent that it would, expressly or by reasonable implication, limit the scope of this delegation or impose conditions or restrictions upon the exercise of the authority delegated, will be controlling over it.

    5313.003 Policy

    (i) The determination that micro-purchases and simplified acquisitions of supplies or services are used in support of a contingency operation or to facilitate defense against or recovery from nuclear, biological, chemical, or radiological attack is delegated from the head of the agency to the HCA’s as described in 5301.601 (a)(i)(A)-(D). HCA’s may delegate this authority no lower than the chief of the contracting office, as defined in 5302.101.

    SUBPART 5313.2 -- MICRO PURCHASE

    5313.201 General.

    (g)(1) The head of the agency determination is delegated to the HCAs as described in 5301.601(a)(i)(A)-(D). HCAs may delegate this authority no lower than the chief of the contracting office.

5317.7404-3 and MP5317.7404-3 - Incorporates new Mandatory Procedures for Undefinitized Contract Actions

    Supplementary information about the change: The DoDIG reviewed Air Force management of Undefinitized Contractual Actions in Report No. D-2004-112. One of the recommendations was to require contracting officers to provide written justification in the contract file for surpassing DFARS definitization schedule milestones. As a result of this recommendation, the Air force agreed to strengthen management reporting for late definitization, in addition to requiring written contracting officer justification. This revision requires field offices to submit a written report to UCA approving authorities details on any UCA that is not definitized within 180 days after the contractor submits a qualifying proposal. The UCA approval authority must report any UCA not definitized within one year to AF/AQC.

5342.1503 - Adds language linking to the Air Force Contractor Performance Assessment Reporting system (CPARS) Guide

    Supplementary information about the change: None.

    5342.1503 Procedures.

    The acquisition team shall use the Contractor Performance Assessment Reporting System (CPARS) to record evaluations of contractor performance. Guidance on systematically assessing contractor performance and using past performance information is available in the Air Force CPARS Guide.

5346.103, MP5346.103, and IG5346.103 - Incorporates new Mandatory Procedures and Informational Guidance for Quality Assurance Procedures

    Supplementary information about the change: The recent revision of AFI 63-124 removes the Quality Assurance (QA) language, which outlined the required contracting training for quality assurance personnel (QAP). Training included QAP coordinators and Phase I and II given to functional QAPs. Due to the removal of this coverage in the AFI, we are placing the previously established language into the referenced MP and IG.
